Terms of Service

Last updated: 30 May 2026

These Terms of Service govern your access to and use of askkenny.biz and the business-funding advisory and broking services provided by FinMart Pte Ltd, trading as AskKenny ("we", "us", or "our"). Please read them carefully. By using our website or engaging our services, you agree to these terms.

1. Acceptance of these terms

AskKenny is a trading name of FinMart Pte Ltd (UEN [UEN to be confirmed]), a company incorporated in Singapore with its registered office at [Registered office address to be confirmed]. In these terms, "you" means the person or business accessing our website or services.

By accessing our website, submitting an enquiry, or engaging our services, you confirm that you have read, understood, and agreed to these terms and to our Privacy Policy. If you do not agree, please do not use our website or services.

2. Our role: advisor and broker, not a lender

We provide general information and business-funding advisory services, and we act as an independent broker and introducer between Singapore small and medium enterprises and banks and licensed financial institutions.

We are not a bank, a lender, or a licensed moneylender. We do not lend money, extend credit, or take deposits. Any loan, facility, or financing is provided by the relevant bank or licensed financial institution under its own terms, criteria, and regulatory obligations. We do not control and are not responsible for the decisions, products, rates, terms, or conduct of any financial institution.

3. Information only, not professional advice

The information on our website and in our communications is general in nature and is provided for information purposes only. It does not take into account your specific circumstances and is not intended to be, and should not be relied upon as, financial advice on investment products, legal advice, tax advice, or accounting advice.

Before making any funding or financial decision, you should obtain independent professional advice that is appropriate to your situation. Any decision you make is your own, and you are responsible for it.

4. No guarantee of approval or outcome

We do not guarantee that any application will be approved, or that any particular amount, rate, tenure, or timeline will be offered. All applications are subject to the relevant financial institution's eligibility criteria, valuation, credit assessment, documentation, and regulatory requirements.

Any figures, examples, thresholds, or timelines shown on our website are illustrative only, may change without notice, and do not constitute an offer, a quotation, or a promise of any outcome.

5. Eligibility and your responsibilities

By using our services, you confirm that:

  • You are at least 18 years old and legally able to enter into a binding agreement.
  • You are the business owner or an authorised representative of the business on whose behalf you are enquiring.
  • The information you provide is true, accurate, complete, and not misleading, and you will keep it up to date.
  • You will not submit another person's personal data unless you are authorised to do so and that person has consented.
  • You will use our website and services only for lawful purposes.

6. Fees

We do not charge you upfront fees for our advisory and introduction services, and our advisory services are complimentary unless we agree otherwise with you in writing. We may receive a commission, referral fee, or similar payment from a financial institution if your application proceeds. This does not change the eligibility criteria applied by the financial institution. If any fee would ever be payable by you, we will tell you clearly before you incur it.

7. Enquiries and communications

When you submit an enquiry, you consent to us contacting you about it by phone, email, WhatsApp, or messaging. Some parts of our service use third-party platforms such as WhatsApp and Meta. Your use of those platforms is governed by their own terms and privacy policies, which we do not control.

We handle your personal data in accordance with our Privacy Policy, which forms part of these terms.

8. Intellectual property

All content on our website, including text, graphics, logos, the AskKenny name, layouts, and design, is owned by or licensed to us and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to view and use the website for your own lawful, non-commercial purposes.

You may not copy, reproduce, modify, distribute, republish, or create derivative works from our content without our prior written consent.

9. Acceptable use

You agree not to:

  • Use the website or services in any way that breaches any applicable law or regulation.
  • Provide false, misleading, or fraudulent information.
  • Impersonate any person or misrepresent your association with any person or business.
  • Attempt to gain unauthorised access to, interfere with, or disrupt the website, its systems, or its security.
  • Use any automated means to scrape, harvest, or collect data from the website without our prior written consent.

10. Third-party links and services

Our website may contain links to third-party websites, platforms, and services. We provide these links for convenience only and do not endorse or take responsibility for their content, products, services, or privacy practices. Your dealings with any third party are solely between you and that third party.

11. Disclaimers

Our website and services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations of any kind, whether express or implied, including as to accuracy, completeness, reliability, suitability, availability, or fitness for a particular purpose. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

12. Limitation of liability

To the maximum extent permitted by law, we, our directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, or for any loss of profit, revenue, business, goodwill, data, or opportunity, arising out of or in connection with your use of, or inability to use, our website or services, or your reliance on any information provided.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with our website and services, whether in contract, tort (including negligence), or otherwise, will not exceed the total fees, if any, that you have paid to us in the twelve months before the event giving rise to the claim. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under Singapore law.

13. Indemnity

You agree to indemnify and hold us, our directors, employees, and agents harmless from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these terms, your misuse of the website or services, or your provision of false, misleading, or unauthorised information.

14. Changes, suspension, and termination

We may update, change, suspend, or discontinue any part of our website or services at any time without notice. We may also update these terms from time to time. The latest version will be posted on this page with an updated date, and your continued use after any change indicates your acceptance of the updated terms. We may suspend or restrict your access to the website if we reasonably believe you have breached these terms.

15. General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These terms, together with our Privacy Policy, form the entire agreement between you and us regarding your use of our website and services.

16. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of Singapore. You agree to submit to the exclusive jurisdiction of the courts of Singapore in respect of any dispute arising out of or in connection with these terms, our website, or our services.
